Breaking news from Maui.
HouseConcurrentResolution 10 has been PASSED, UNAMENDED.

Seen as yet another evolution of medical marijauna, HCR10 offers a “family farmer” regulation and “Revenue program to tax and regulate the sale of marijuana for adult use.” Imagine being a licensed medical marijuana farmer providing for the sick, being a tax paying addition to the community, and growing other organic crops to support all of the communities on Maui. This bill also makes adult marijuana use the lowest priority to the MPD. Letting them go after real criminals. Damned iceheads! Anyway, we here on Maui are proud of pushing the envelope and look forward to the future.

RESOLUTION

REQUESTING THE MAYOR AND THE COUNCIL OF MAUI COUNTY TO IMPLEMENT VARIOUS MEASURES REGARDING MEDICAL MARIJUANA IN THE COUNTY OF MAUI.

WHEREAS, Hawaii has enacted a medical marijuana law that enables a qualifying patient who has been diagnosed by a physician as having a debilitating disease and for whom the potential benefits from the medical use of marijuana likely outweighs the health risks, to possess and use an adequate supply of marijuana for medical purposes; and

WHEREAS, eleven other states have enacted similar medical marijuana laws, including Alaska, Arizona, California, Colorado, Maine, Montana, Nevada, Oregon, Rhode Island, Vermont, and Washington; and

WHEREAS, on June 6, 2005, the United States Supreme Court, in Gonzales v. Raich (545 U.S. 1 (2005)), affirmed the constitutional authority of the United States Congress to regulate the interstate market in drugs, including small, homegrown quantities of physician-recommended marijuana for medical uses under a State’s medical marijuana law, which, for the purposes of federal enforcement, effectively bans the possession and use of marijuana for any purposes, including medical use; and

WHEREAS, despite the Supreme Court decision, the reality remains that many patients in the State, particularly on the island of Maui, rely on the use of marijuana to alleviate their pain and suffering that cannot be addressed in any other ways; now, therefore,

BE IT RESOLVED by the House of Representatives of the Twenty-fourth Legislature of the State of Hawaii, Regular Session of 2007, the Senate concurring, that the Mayor and the County Council of Maui are strongly urged to implement various measures regarding medical marijuana as follows:

(1) Develop a Maui County Family Farmer Medical Marijuana Regulation and Revenue Program to tax and regulate the sale of marijuana for adult use;

(2) Under the program:

(A) License qualified family farmers in designated agricultural zones to produce marijuana and allow each licensed family farmer to produce marijuana for up to two hundred qualifying patients;

(B) Create an allotment system allowing agriculturally zoned family farmers on the island of Maui to supply the medical marijuana needs of Maui by requiring five-year organic farm plans based on at least two organic crops, the first of which shall be marijuana and the second of which shall be an organic vegetables crop; and

(C) Create a community oversight committee to oversee the implementation of the program;

(3) Direct the Maui County Police Department to make investigation, citation, and arrest for private adult medical marijuana offenses the lowest law enforcement priority; and

(4) Advocate for legislative change to further legalize medical use of marijuana at the state and the federal levels; and

BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Mayor and the Chairperson of the Council of Maui County.

So I was in Vegas last week and had the chance to go to Bobby Flay’s Mesa Grill. The Food Network staple opened his only restaurant outside of New York a couple of years ago. I can only imagine what his rent is inside of Casear’s Palace. Mesa Grill is right next to the biggest and best sports book in Vegas, has the Pussycat Dolls lounge as a neighbor and is across from the best nightclub ‘Pure.’

I went with a couple of good friends on a Sunday around brunch time. Mesa grille was busy, but not packed. I had walked by a couple of nights before and it was BUSY. Read the rest of this entry �

A lot has been happening on the medical marijuana front. New Mexico’s governor and 08′ Presidential hopeful, Bill Richardson is fully supporting his states medical marijuana Bill. He states: “I don’t see it as being a big issue. This is for medicinal purpose, for … people that are suffering. My God, let’s be reasonable.”

Now you have Minnesota’s legislation overcoming a major hurdle. The important House public safety committee was heavily attended by vocal law enforcement and still passed. Sorry guys, but people are tired of seeing suffering. One of the ways Minnesota is compromising to get this passed is to have only sanctioned nonprofit organizations grow up to 12 plants and 2.5 ounces per patient. It is all about balance.

It is really nice to see something that sarted with Prop. 215 in California and has blossomed into 11 sates and still growing. Pun intended.

OK, so it really isn’t about the bong hit here, but really about how far a school can go to censor a student.

A high school student from Juneau, Alaska was suspended for holding a banner up that said “Bong Hits 4 Jesus.” as the Olympic torch passed through town. Although this happened during school hours, he was ACROSS THE STREET from the school on a PUBLIC sidewalk. The student, Joseph Frederick lawyer says: “This is a case about free speech. It is not a case about drugs.” The kid was just trying to get on TV. I didn’t know censorship was part of a school’s anti-drug mission. We won’t here the decision till some time in June. Stay tuned.

This whole story kind’ve leaves me with a sour taste. Some knuckle heads in suburban Fort Worth, Texas, thought it would be cool to burn out their 2 and 5 year old Nephews while videotaping it. WTF? How high do you have to be to do this? Wrong on so many levels. I mean the tape shows the 2 year old holding the blunt and taking a hit like he had done it before. How tragic. VERNONIA, Ore. (AP) — State and federal authorities have arrested a Vernonia mail carrier, Ronald Richard Berkan, Jr., after his indictment on charges of distributing marijuana, sometimes from his postal delivery truck.

The indictment says Berkan, 46, distributed pound quantities of the drug to underage buyers in the Cedar Mill area of Washington County, a Portland suburb, over a period of years.

Three search warrants were executed, two on residences in the Cedar Mill area and a third at Berkan’s home near Vernonia in the Oregon Coast Range of Columbia County where an indoor marijuana-growing operation was found. Read the rest of this entry �
